The Hazlet Township Committee will hold a public hearing on an ordinance establishing a 30-year agreement with the Bayshore Regional Sewerage Authority at their Feb. 19 meeting. The Bayshore Regional Sewerage Authority, often called "The BRSA," is a government agency that handles the raw sewage of eight towns, by transporting, treating and disposing it, and discharging cleaned water into the Raritan Bay. The Bayshore Regional Sewerage Authority will ask the NJ Appellate Court to reconsider its recent ruling in favor of the Union Beach Planning Board, according to a report by The Independent. On Aug. 10, the New Jersey Superior Court Appellate Division ruled that the Bayshore Regional Sewerage Authority must seek site plan approval from the Union Beach Planning Board before finishing construction of their wind turbine. After an injunction was granted to halt construction of the turbine in July, the Union Beach Planning Board has won their appeal against the Bayshore Regional Sewerage Authority
The New Jersey Superior Court Appellate Division ruled today that the Bayshore Regional Sewerage Authority must seek site plan approval from the Union Beach Planning Board before finishing construction of their wind turbine. Attorney Stewart Lieberman, who represented the Union Beach Planning Board during the appeal, explained that the case emphasizes that while state approvals are necessary, so are local ones. "We won. Delivery of the turbine components was scheduled to begin Monday
The New Jersey Superior Court of Appeals issued an injunction Wednesday on behalf of Union Beach, halting construction of the Bayshore Regional Sewerage Authority's wind turbine. Conti Group, which has been contracted by the BRSA to build the turbine, must not only stop construction but also begin to demobilize by removing their equipment and their crew, explained BRSA Executive Director Rober Fischer. "Union Beach has filed an application for a restraint to stop the Authority from transporting and building the turbine. We received it yesterday and we're going to abide by it," Fischer said. The council voted to authorize Mayor Buccellato to sign an agreement with Conti Enterprises
The Matawan Borough Council voted unanimously to authorize Mayor Paul Buccellato to sign an agreement with Conti Enterprises to approve the transportation of wind turbine components through the borough. Conti Enterprises is the company contracted by the Bayshore Regional Sewerage Authority to build a wind turbine in Union Beach. According to an official email received by the borough in Oct. 2011 from Eric Millard, the project manager at Conti Enterprises, it will take an estimated ten minutes for the seven separate components of the turbine, carried on tractor trailors, to pass through Matawan. The Bayshore Regional Sewerage Authority (BRSA) approved an additional $268,000 in available funds for unforeseen expenses related to the wind turbine it plans to install on its property in Union Beach. The funds, approved through a change order request at the BRSA's regular action meeting Monday night, are available for distribution over the next five months. The Monmouth County Bayshore Outfall Authority has an outfall pipe that receives BRSA and TOMSA TREATED effluent, and that pipe discharges into the ATLANTIC OCEAN far off Sandy Hook.
